I have been retained by defense counsel to evaluate an evaluee in connection to a life care plan.  The plaintiff attorney is insisting that the interview be recorded.  As a vocational expert, I'm clear that recording by a third party violates our testing standards.  However, I'm not aware if it also violates any life care planning standards.  I welcome any feedback.  Thanks!

Dr. Shanasarian wrote eloquently about the matter back in 2009, I believe, Volume 17 No. 4 Rehab Pro.

Mike, I have not heard of such a ban for life care planning. I do see some of the physicians that I work with on LCPs video the defense IME.

If I am being an observer for the plaintiff attorney during a defense IME, I will record it on my phone then email it to the plaintiff attorney.

Thanks everyone for the good feedback. Opposing counsel was amenable to dropping the recording requirement.
