This story from Medscape rolled out earlier this morning: http://www.medscape.com/viewarticle/871580?nlid=110547_3901&src=wnl_newsalrt_161109_MSCPEDIT&uac=120272CG&impID=1230967&faf=1
It would now seem to be a certainty that the ACA as we know it has a very short life expectancy. I expect there to be a shift in the winds driving development of Life Care Plans, especially on the defense side. What most credible life care planners have been saying about the use of collateral sources and the application of the ACA appears to have now come to pass. It will be interesting to see how the courts react to what will no doubt be the forthcoming major policy and ultimately legal shift in how we pay for health care in this country and how we are expected to address this in our cases.
