  • 1.  Professional Healthcare Liability Insurance by Mercer

    Recently Cheryl Kaufman raised the following question about coverage for life care planners on a post on the LCP Forum.

    To the life care planners out there... 

    I have had Professional healthcare liability insurance coverage with Mercer through IARP member benefits. However, Mercer will no longer provide Rehab Professionals/Life care planners with coverage for any claims "based on or arising out of any actuarial act, error or omission." 

    While I am hoping I never need it, I was wondering if you might make a recommendation for an alternate professional liability insurance company that provides coverage for claims arising from errors or omissions.

    Carl, 

    I have reviewed in detail the non-direct patient care endorsement that was introduced in 2014 to include coverage for Life Care Planning. This endorsement was created prior to my time with Mercer; however, it was my understanding IARP had a lot of input in the structure of this endorsement 

    Our program is intended to be healthcare focused where we are extending coverage for direct and non-direct patient care, such as life care planning. It is not our intent to cover exposures related to non-healthcare activities such as those of an actuary or economist. While I recognize life care planners may work with actuaries, it is my understanding they do not do the actuarial science or valuations behind the plans. 

    The exclusion states the following:

    “To claims based on or arising out of any actuarial act, error or omission” 

    I did receive a call last evening from Cheryl and will be returning her call this afternoon.

    Absolutely not.  Mercer responded to a detail about coverage.  There is no change.  Mercer will continue to provide coverage as it has for many years.

    I echo what Carl has said as this has been my understanding since my term as IARP President from 2005-07 when the issue of professional liability coverage for the membership was one of the priorities of my term. This language is consistent with how our policy has always existed. If your scope of practice allows you to work as a RN, Rehabilitation Counselor or related allied health professional member of IARP covered by the policy, your work as a life care planner will be covered.

    If you work as an economist or actuary, however, you need a separate policy that is available from carriers that write such coverage.  Stick to life care planning and you are covered. Stick to your clinical scope of practice and you are covered. Of course, I will defer to our Mercer rep for definitive answers to questions as per what was sent out earlier today, but I see no changes from where I sit.  Our firm has its coverage with Mercer and are covered for what we are qualified to do.  I would also encourage our members to run the policy language by your personal attorney if you wish.

    I called this company and told them that I belong to AREA and what they do.  These are rehab counselors that also do economic evaluations.  I also requested to know if FCE evaluators are covered and again they said yes.  The insurance agent said that they would cover my insurance.  However Bob said they will not.  Which is it, can someone respond.  Other people have told me that this company does not cover LCP, which again is a concern.

    Ron, I did not say they would not cover economic evaluations. The language from the Mercer rep in a prior email from Carl is was what I was referring to.  I do not know why some people are concerned about whether life care planning is covered.  I think that was addressed by the Mercer rep in Carl's email.  I do suggest that the question of "economic evaluations" might want to be clarified with Mercer by IARP leadership.   Their reference to "actuaries" etc. defines a totally different kind of expert than what I would expect the IARP policy with Mercer would cover.

    As with anything with regard to insurance coverage, check with your own attorney or call Mercer and pose the specific question you may have.  I do not see any issue if you do life care planning and are qualified to practice as a life care planner. Certification would seem to satisfy that requirement.  If you are not certified in life care planning and practice as a life care planner, you might want to re-visit that.

    Please don't think that I am giving any legal advice. I am not. I am trying to share some of the history here and support what Carl posted earlier.
