  • 1.  When are we officially retained

    I spoke to a def attn who I have never worked with about a case, did not get case name, sent blank contract, fee schedule, CV and case list 15 days ago. I have not heard back. Today, I got a call from the plaintiff attn who I have worked with in the past and the accident description and location sounded familiar. The defense firm was the firm I originally talked with. Can I take the case from the plaintiff? What is my ethical obligation? I do not consider being retained until I receive the contract and retainer. Is it ethical to take the case from the plaintiff and inform the defense of such if they contact me again or should I discuss with the defense firm first

    Tracy, your position is the same as ours.  No formal retention, no conflict if the other side contacts you.  I do not even see an obligation to inform the other attorney unless you see the personal need to.

    I don't think you are under any obligation to the defense. If you had issued a contract with a name and an invoice, I would immediately send them a notification that you have cancelled the contract due to no signature or payment.  Then, accept the case from the plaintiff.

    Tracy,

     

    I would tell the firm that you want to work with that if they want to work with you to send the contract pronto with retainer.  Then for good business relations tell the other firm, once you receive the cash and contrac,t that the other firm provided consideration (legal term for hand shake on the deal) to work as their expert.  You send two messages, if they want you move fast and prove it.  Good luck gal.
