  • 1.  Life Care Planners completing MSAs

    I cannot find anything which talks about a  Life Care Planner doing a Medicare Set-Aside Agreement (credentialed in both/dual certification) on the same person/client. Seems logical but I was recently questioned if this dual relationship is okay per standards. Any input is greatly appreciated.

    I don't see why it would be contraindicated and I have never heard anything against it.  Many of the EE's at larger companies do both on same client.

    Jennifer,

    You can refer to the 3rd edition of the Standards of Practice for Life Care Planners.  All IALCP members recently received a printed copy by mail.  It is also available online.

    There is an appendix that gives you the current ethical standards and there is a section on dual relationships.  Bottom line is that dual professional relationships can be OK if the roles are not used for the purpose of providing benefit to the professional.

    Remember that the goals of the LCP are not the same as the goals of the medicare set-aside and you  may find yourself having to testify about  the differences. May be tricky . . Would be happy to discuss privately

    Customarily in MSA the life care planner is attempting to "streamline" - i.e., minimize - the cost of future medical care in order to help the parties get a settlement approved. On the other hand, the life care planner's role in a PI case is to pinpoint ALL of the treatment needs the evaluee is going to encounter in future. While this is not unethical in the strict sense, from a practical standpoint it could become an intense conversation for the life care planner who ends up being called to testify. That's all I'm saying...
