    I am very pleased to attach a copy of the IARP/Life Care Planning IALCP Section Standards of Practice for Life Care Planners Third Edition.  I also want to pay tribute to Karen Preston, chair of the Standards of Practice Committee, and the dedicated volunteers who contributed to this valued resource for the our community.

    As Karen writes in the forward, "Creating the third edition of the Standards of Practice was a project that reflected the growth, change, and maturity of this field of practice."  She further acknowledges that 14 years after the first edition was drafted, our revised standards reflect our practice's becoming more objective and research-based.

    Take a look at  the names of the members of our section and other life care community leaders who are listed in the opening pages.  The revision committee and the advisory group members from throughout North America began their work in January 2013 and labored for over two years to make this achievement possible.

    Many of you may have attended the sessions at the International Symposium of Life Care Planning in Minneapolis or the IARP Annual Conference in San Diego last fall where Karen presented background on the Standards.  For those who missed these informative presentations, we also are making Karen's presentation available through IARP LEARN for no charge.

    The IARP staff has mailed to you a printed copy of the Standards of Practices from Glenview this morning.  You may purchase additional copies of the printed IARP Standards of Practice for Life Care Planning Planners for $15 each (postage included).  You may also order online through IARP's shopping cart.

    Copies of the standards will be available for sale to non-members for $30.

    Remember these standards are copyrighted and may not be reproduced without the written consent of  IARP and the Life Care Planning IALCP Section.

    Quick question to the leadership of the IALCP and IARP:

    The copyright issue means, I take it, that if asked to copy and produce these standards as part of a litigated case, say as an exhibit to a deposition, we are not to do so, correct? If this is so, I assume we direct the party requesting the standards to where they can purchase the document, just like we would do with an article from a journal that is copyright-protected?

    I am somewhat surprised at this. Shouldn't standards of practice for other professionals be available in the public domain? Is there precedent for the decision to keep these standards protected in this manner?

    Hi Bob,

    In response to your first question, the answer is yes.  Someone who wants a copy of the standards can purchase them from IARP.

    Regarding your other questions, yes, there is precedent.  The Standards of Practice Committee considered what other organizations do, as well as what we have done in the past.  Noting that many organizations do charge for copies of their standards (e.g., CMSA, ANA, ARN), the SOP committee advised the IALCP board of the facts and asked the board to decide what was best for IALCP.  The IALCP board decided that it was certainly reasonable to charge a fee for the updated standards.

    I appreciate the protections that copyrighting the standards holds in regards to not letting individuals alter or adulterate the materials, or adopt them into their practices / professions without consent from the IALCP. 

    The standards also provide important education about life care planning to people outside of the profession and I wonder if charging for them will mitigate this vital task.  Life care planning is not a household word and in the relative time I have been privileged to serve as a life care planner I have been surprised to find how many key people do not understand the practice or its principles – this includes a surprising number of attorneys, as well as trust managers, actuaries, etc.  Making sure that these individuals have easy access to the standards is often a very effective way of starting an important discussion.  This document has a vital role in professional advocacy and the growth of the profession.

    Open distribution of the standards can also help educate publics regarding the important differences of certified life care planners regarding others, not so qualified, who represent their life care planning, cost analysis, and other purported equivalent services.  This has been especially important in depositions, testimony and court challenges.  Assuring that all counsel (or other decision makers in a case, regardless of whether it involves litigation) has easy access to the standards can help mitigate a number of challenges.  Charging a fee for the standards can provide a “convenient excuse” not to be “educated.”  It has also been interesting to discover in research for cases or other activities that life care planning is not a legitimate practice, does not meet Daubert requirements, that it was created by the plaintiff’s bar, etc.  Our chapter and verse directly addresses these issues.

    I appreciate the hard work that the committee did in establishing these standards and it was a privilege to participate in the advisory group.  I respectfully offer the above as food for thought and would be interested in others comments.

    Does that mean the standards will not be in the JLCP?  In essence, as members of IARP/IALCP we should already have paid for these if they appear in the journal through our membership.

    We are able to provide full copies to others if we purchase an extra copy.

    In answer to your question about quoting the standards in a report, I believe that like any quoted information, that would be acceptable with appropriate citation of the source.

    The standards are free to IALCP members, with one hard copy and one electronic copy being provided.  The standards will also be printed in the JLCP later this year.  (Yes!  The JLCP IS coming back!)

    Anyone who wants to purchase a copy (or, in the case of members, an extra copy) to generally educate others, or to provide to a client, or to comply with a request for standards, will be asked to pay a $30 fee for each copy. 

    FYI, the following is my personal plan, and not an IALCP conclusion or recommendation.  I am speaking as a Life Care Planner only.  If I am asked to provide a copy of the standards as part of the deposition process, I plan to buy the copy and bill the individual who made the request.  If I provide a copy to someone for whom I am working, or to a prospective client, I plan to purchase the copy and consider that a marketing cost.

    My reply is not intended to speak on behalf of IARP or IALCP.

    Bob, you will find a mixed bag of practices among professional organizations regarding availability of standards and codes of ethics.  Some do not even offer free access to their own members, while others are free to all, and others offer it free to members but not to the public.  There are several factors that go into this decision, including real costs incurred in creating the document, financial health of the organization, and philosophical beliefs about what is "right" or whether being free diminishes the value.  There is not a consistent practice, so there is precedent for any decision.

    Karen/Patty, I would think that if we wanted to publicize these standards and encourage their recognition, we would publish them openly on the IARP website. Chalk me up as one who is disappointed at the decision to not do so. I hope the IALCP and IARP boards revisit this decision.

    I concur with Bob Taylor.  Standards should be transparent.  Open to the public.  Making access difficult only makes it look like the organization is hiding something.

    I agree  with Bob, Dorothy and Michele.  Just from a logistics standpoint, it seems cumbersome.  Each time that I want to use a copy of the Standards (if I want to share with anyone one the case), I will have to order a copy, figure out how to pay IARP on line and bill my file.
