I was contacted by a Florida defense attorney today looking for an expert who is a CLCP, but also has expertise in the VA health care system. This is for a Florida case where the PL has agreed to binding arbitration. Under the Florida arbitration provision of the medical malpractice statute, the PL is not entitled to recover damages for future care needs that are covered by the VA healthcare system. She already has an LCP expert in the case, but she is looking for an expert to address the narrow VA coverage issue. This post is not intended to ignite a storm of discussion regarding collateral sources, but instead is intended to identify an expert with this skill set.
