    Looking for input and thoughts on the practice of handwritten notes taken during the intake being shredded after the report has been submitted, and not available at deposition.

    Seems inconsistent with sound rehabilitation forensic practices and lacks transparency.

    I'm not familiar with practices outside the PA, OH, WV area but I can tell you that my notes are one of the first items marked as exhibits in depositions.  I cannot imagine going into a depo without my notes.  The attorneys would likely take action to either disqualify my testimony, move for sanctions or both. In any event, my reputation and career would suffer.  The same holds true in my experiences at the Federal level.  The only time I have seen experts deny access to notes is raw data used in testing. Again, many attorneys believe you are hiding something and push relentlessly when denied full access to anything used in the formation of your opinion. Be safe, take professional notes and be prepared to offer them when asked.
