I think the most immediate effect of the impending start of implementation of the Affordable Care Act for life care planners is a decrease in referrals. The one thing that seems clear is that no one knows exactly how implementation will play out in the real world next year. When attorneys are faced with uncertainty they hesitate to refer cases to life care planners.

I had a lawyer review this article a year ago and he did not think ACA would have that much impact on life care planning.  I was also somewhat concerned about it as well, but he indicated that it would fall under the same collateral source rules like every other insurance policy does.  He made a good point that it is rare that he has a client who does not have some sort of insurance.
