  • 1.  Transportation Rate for LCP

    There is some disagreement by myself, the attorney and the economist regarding the above for a current LCP.  Based on 2013 IRS mileage rates, the economist suggests $.565o per mile (2013) for travel to appointments (business rate), the attorney feels that the rate should be $.2400 per mile (medical mileage rate) and I have historically utilized $.5650 or whatever the current federal rate was for that year and not considered medical vs. business rate.  I am interested to know what the collective is using as a rate for travel to and from medical appointments.

    We use the medical rate as it is the most defensible for both plaintiff and defense.  I had a plaintiff attorney say I was "cold" during a depo for not including the business rate.
