  • 1.  Reasonable job search effort

    I wonder whether anyone has any articles that do a good and credible job at characterizing a "reasonable job search effort," ideally touching on duration and number of contacts or number of interviews, particularly with high earners. Thanks.

    Steve: Here is a list of various publications & references that may assist you.


     If your case is a Wrongful Termination, I have a lengthy (40 page or so) Journal of Legal Economics "Assessing Economic Damages I Wrongful Termination Cases" - Volume 23, Number 1, O October 2016. It speak also to the issue of how long one may be poisoned before recovery. Lots of Legal decisions and References of 1.5 pages long.


    Let me know if that too could assist you now or future and I will upload you a copy.

    I agree with Michelle's mention of What is a Reasonable Job Search? Developing a Theoretical Framework by David Stewart and Daniel Turner. It provides an excellent rubric to objectively quantify an individual's job search efforts.

    I have used many of the same references. But I would caution against testifying about the 40 hour per week bit. Reasons for such ought to be obvious.  Over the decades of WC rehab, OWCP, and forensic cases I had opportunity to work with and evaluate thousands of job seekers as either an RC, VE or supervisor of RC, VE and job developers. I don't recall any client EVER qualifying if 40 hours per week is seen as the measure of what is reasonable or diligent. Same is true with regard to friends, relatives, self. Testifying, a VE must always strive to be perceived as reasonable. If that 40 hour per week barometer is used as THE measure, rest assured that every person in the courtroom; the jurors, anyone reading such in your report will most likely squirm, think such is a bit crazy/unrealistic, and quite possibly wonder what else the VE has said is baloney as well.

    Job search is difficult, stressful, often depressing. I have yet to meet a human who dd it 40 hours per week and already do not believe anyone who says they do.
