  • 1.  interrogatory Fee for a Family Law Case

    Hello everyone,

             I usually do not receive a interrogatory request for family law cases. The interrogatory has less than ten questions and is due prior to April. Opposing council is requesting this. As a rule of thumb I assume we do but is there a charge for an interrogatory ? I have not been deposed by opposing council? Thank you for your help in advance!

    Whatever number of actual hours you spend reading and reviewing the documents and your work product in order to answer each and all of the questions multiplied by your hourly rate for forensic work.

    I agree with Scott $ x hours of your normal fee. But would send a fee agreement and get it signed first. Who retained you? Ask the attorney. I would not do this "free".

    This may go without saying, but I have not seen it noted here:  any and all communications between you and the opposing attorney on a case matter such as this, may and should be shared, if not discussed, with the counsel who is retained on behalf of the same client as are you.   This applies especially before making any response of any kind to such communication.  Good luck!
