  • 1.  Intake Form Question

    Hello Everyone,

    I am new(ish) to Liability work and have a question.  I appreciate the wisdom of this group!  The opposing attorney on a new case of mine has requested a copy of my intake form prior to agreeing to my evaluation of the client.  Have any of you experienced this and should I provide this document?

    Kathleen: This request has happened a few times in my practice. I do not get bothered by this move or motive.

     

    1. If your forms are not Copyright protected, you are not doing anything wrong. Is it form you created?
    2. You would ask the same questions at the interview so you have nothing to hide.
    3. Equally or perhaps most important, the attorney can and or will get your complete file if they file a "Subpoena Duces Tecum".  That means production of evidence and is a court order.
    4. It is possibe they want to get the client to fill out details in advance to save time or get prepared to deal with you later?  Are you organized? How much detail do you obtain by using a standardized form?  I use a standardized 13-page intake form for all assessments. This helps with remaining objective on data collection no matter the referral source or defense or plaintiff case.

    Kathleen,

    I agree with John B. The form is discoverable if you use it for your evaluation. I see no harm in sharing it with opposing counsel. I would suggest that you clarify that you might not fill out the form in its entirety as the information you gather is case specific (I have a 10-page form that I use for all of my evaluations regardless of the case type or referral source.) You also might want to consider providing opposing counsel with a copy of your written disclosure form in advance of the evaluation.
