  • 1.  Family Law Voc Evaluation Rule/Regulation Help

    Good evening,

          I am reviewing a Vocational evaluation in the State of Florida. The eval so far is certainly not how I conduct my evaluations but everyone has their own style I suppose.

        There are a couple red flags, this individual who was evaluated has a GED and the last time they made above 60k was in 2011. This evaluator is citing they can perform a certain semi-skilled job that she has never performed before and the wage is taken from only one job (mind you there is only 1 job for example coal miner within a 50 mile radius of her home) and indicated her salary can be about 60 k derived from this single job with only one position in the labor market in her locality medial wage is $36k according to BLS.

    This is one of many flags but truly I am wondering if there are any documented statutes and or guidelines to best object to the evaluator's methodology or is it the Wild West.

    Basically, it's the wild west, ie, whatever a person thinks they can get away with.  However, I have heard attorneys say that judges will usually not grant an imputed income way over what they ever made in the past.
