  • 1.  Convictions and length on record if vetted

    Resource request: I seem to rarely work with the issues of convictions and how that impacts re-employment options so lack what and how to consider these condition(s) as a vocational barrier to even simple light, unskilled work.  Does anyone have citing's on what types of "convictions" interfere with re-employment?  The evaluee has a lot of issues though 15-19 years ago. Court ordered treatment seemed to clean him up and no issues since 1999. Examples are:

    Malicious mischief, DUI x 1, disorderly conduct, criminal trespass, driving without 4x and two x 4th degree assaults.

    Of course, I do not want to consider if the length of time from conviction is now irrelevant and employers are not able to consider do to time passing.

    It is my understanding that employers can only go back 10 years with regard to criminal records.

    In the State of Washington, most employers do their background checks
    through the Washington State Patrol, as it is on line and far less
    expensive than an FBI check. When the record comes back, it will have all
    convictions in the State of Washington (but no other states). Although
    many employers say that they only consider felony convictions in the past 7
    or 10 years, they will still see all convictions (felonies, gross
    misdemeanors and misdemeanors) . If an applicant has a long rap sheet,
    any reasonable employer is going to consider the sum total of the criminal
    history, not just the last 7-10 years. Also, in Washington, there are
    strict laws about which specific convictions would not allow for a person
    to work with vulnerable adults, children, etc. The list is quite long.

    Thanks Janice, that outline given is consistent with my foggy recall too. Nice to hear from you, I thought you had retired as both of us have been in this business for what, 34-35 + years!

    Actually, the law maybe that they can only go back 10 years, though I have been told by more than one employer they go back 20 years, and any type of violent crime many disregard. Most of the reintegrated that I have come across, and I work with a couple of reentry programs, it is very difficult for people to find employment, most going to work only in temp agencies where backgrounds mean less. The other thing to consider is that if he has had court ordered treatment, no matter how long ago, he may have a qualifying disability for V.R. Just my two cents worth. Here is a link I found.
