    I have a NC w/c question involving an IW who has failed two urinalysis tests while under the care of a pain management specialist.

    IW failed a test in the Summer of 2012.  The MD dropped him and I was asked to find a new pain management MD to assume care.  I did and after two months IW failed anther urine test.  MD dropped IW.

    IW is not getting indemnity since he is working at his pre-injury wages.  His medical is a lifetime award.  Since he is using illegal/non-prescribed medications while under the care of a pain management MD, can his medical benefits be terminated for noncompliance with medical treatment?    The other question is, now that he has burned his bridges with local pain management MD's, do you think another pain management MD in another area would be willing to pick him up?  I seriously doubt that especially after two failed urine tests, but you never know.  Finally, does anyone have any suggestions for pain management MD's in the Greenville area?

    I can tell you that non-compliance with medical care could lead to withdrawal of medical care in FL but if the addiction began during treatment, Claimant atty could ask for detox program here and probably get it IF he is taking more than prescribed of the same rx's. If it was cocaine or something unrelated to his pain tx, I doubt a judge would award detox. Any, after several pain management physicians dropped this claimant for non-compliance, I doubt that another would want to treat him.  It's a slippery slope he and you are on. Good luck!
