  • 1.  Utah Workers' Compensation report format

    Hello all!

     

    We were referred a loss of earning capacity assignment that is a Utah WC matter. Does anyone happen to have a sample report for us to reference and guide how we format the report?

    Lisa: Utah has District Courts, not superior Courts for pi cases. 

    If it's WC, they have administrative and appellate courts. The Utah Labor Commission first reviews before appeals to Utah Court of Appeals. 

    In physical injury cases,  no deduction of income tax is required from settlements. You do need to reduce front pay to a reasonable Present Value(PV), which is the norm anywhere I've worked, be it State or Federal Courts. My experience is limited in Utah to 5 cases; one is presently active just outside of Salt Lake. None were work comp. Maybe our colleague, Ms. Kortney Layton can advise as her practice is extensive in Utah.

    Thank you for the insight John. I did go online yesterday and did a little digging. I imagine so long as the report contains all the data to be considered, research, etc., it will suffice. I did not find any "forms" or report formats. Would love any additional insight offered on this list about Utah WC cases.
