  • 1.  Scholarship Award consideration for (Wage Loss?)

    Good morning,

              I received an call from a attorney requesting if I could testify to wage loss.  I have testified to wage loss numerous times but never testified to a individual who loss a financial scholarship. I reviewed case laws, Florida rules etc, nothing indicates loss of scholarship to a University. I have not accepted the case as of yet as I want to ensure I am staying in scope of practice. Has anyone ran into this in their career or have any suggestions?

    One key issue being degree of certainty...  If the evidence leaves you convinced that person was (more likely than not) going to follow through on that path, than you can summarize and project the implications of that.  In addition, because we so often have paths to opine about that cannot be known for sure, the trier-of-fact often welcomes clearly mapped scenarios: here is what was likely if he had gotten this scholarship, here is what was likely if he hadn't, here is a third option that maps the outcome that was likely if he...

    Thank you Steve for your insight. The individual is continuing education goals with alternative means at this time. I appreciate your input.

    Steve's advice is perfect. Various pre/post scenarios are THE way to go. I use multiple scenarios in most every case. Your case reminds me of a case I had with a young man injured just before he started military pilot training. No guarantees of success. But I painted a picture and backed up asset over asset supporting success plus post military aviation career. I came up with losses of many millions. The jury awarded him to my very nickel. Defense relied ONLY on an economist, no LOEC, no VE. Really stupid move. Malpractice IMO.
